By accessing or using TradeIQ Mentor ("the Service", "the App"), operated by Magoro Smart Systems ("we", "us", "our"), you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you must not access or use the Service.

These terms apply to all users of the Service, including browsers, registered users, and subscribers. Your continued use of the Service after any changes to these terms constitutes your acceptance of the revised terms.

TradeIQ Mentor is an AI-powered trading discipline and journaling application. The Service provides tools including but not limited to: market briefings, trade journaling, discipline scoring, AI-assisted mentoring, economic calendar data, and session notifications.

The Service is intended to support trader education and discipline. It is not a licensed financial advisory service, investment advisor, broker-dealer, or trading signal provider.

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are of legal age in your jurisdiction to enter into a binding agreement. The Service is not available to users in jurisdictions where such services are restricted or prohibited.

To access certain features, you must register for an account using a valid email address or Google account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to notify us immediately of any unauthorised use of your account. We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or pose a security risk.

TradeIQ Mentor offers free and paid subscription tiers. Paid subscriptions are billed monthly in South African Rand (ZAR) on a recurring basis unless cancelled. Prices are displayed at the time of purchase and may change with 30 days' notice.

All payments are processed securely through PayFast, a South African payment gateway. We do not store your payment card details — card information is handled entirely by PayFast. Refunds are provided at our discretion for billing errors or service failures. Cancellation takes effect at the end of the current billing period; no further charges are made after cancellation.

You agree not to use the Service to: (a) violate any applicable law or regulation; (b) transmit harmful, offensive, or fraudulent content; (c) attempt to reverse-engineer, decompile, or extract the source code; (d) use automated means to access the Service without our express permission; (e) impersonate another person or entity; (f) interfere with the operation of the Service.

All content, features, functionality, design, code, and branding of the Service — including but not limited to the TradeIQ Mentor name, logo, Solfeggio sound engine, AI mentor system, and discipline scoring methodology — are owned exclusively by Magoro Smart Systems and are protected by copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for personal, non-commercial purposes. Nothing in these terms transfers any intellectual property rights to you.

The AI Mentor Chat feature uses Claude AI (Anthropic) to generate responses. AI-generated content is provided for educational and informational purposes only. We do not guarantee the accuracy, completeness, or suitability of AI-generated responses for any specific trading situation.

You acknowledge that AI responses are not personalised financial advice and should not be relied upon as the sole basis for any trading decision.

If you connect a MetaTrader 4 or MetaTrader 5 broker account, you authorise the Service to read your account data (balance, equity, open positions, trade history) and — where you have enabled Risk Shield / AutoShield features — to modify stop-loss levels on your open positions strictly according to the rules you configure. The Service never opens or closes positions on its own initiative and never places new trades.

Automated actions are performed on a best-effort basis. Execution is not guaranteed: connectivity interruptions, broker-side rejections (for example, a stop level too close to the market price), platform maintenance, or market conditions can prevent or delay a modification. Positions without a stop loss are not managed by automated features, and the Service will tell you so. You remain solely responsible for monitoring and managing your own positions at all times.

Broker connectivity is provided via MetaApi (agiliumtrade.ai). Your broker credentials are transmitted to MetaApi to provision the connection and are subject to MetaApi's terms and privacy policy. You may disconnect an account at any time from Settings.

To the maximum extent permitted by applicable law, Magoro Smart Systems shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, trading losses, loss of data, or loss of goodwill — arising from your use of or inability to use the Service.

Our total liability to you for any claims arising from these terms or your use of the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we determine violates these terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately.

These terms are governed by the laws of the Republic of South Africa. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of South Africa.

We collect the following categories of personal information:

• Account data: Name, email address, profile photo (via Google Sign-In or direct registration)
• Trading data: Trade journal entries, performance statistics, discipline scores, risk settings, favourite trading pairs
• Usage data: Screens visited, features used, session duration, notification interactions
• Device data: Browser type, operating system, device type, IP address
• Chat data: Messages sent to the AI Mentor, including any chart images uploaded
• Broker connection data: If you connect a broker account — your MT4/MT5 account login, broker server name, and account password (transmitted to MetaApi to establish the connection), plus live account data read from the connection: balance, equity, open positions, and trade history
• Legal consent data: Timestamp and version of your acceptance of these terms

We use your personal information to:

• Provide, operate, and improve the Service
• Personalise your AI mentor experience with your trading profile and performance data
• Send in-app notifications relevant to your trading activity and sessions
• Process subscription payments and manage your account
• Comply with legal obligations and enforce our terms
• Analyse aggregate usage patterns to improve the Service (anonymised)

We do not sell your personal data to third parties. We do not use your trading data for advertising purposes.

Your data is stored securely using Google Firebase (Firestore), hosted on Google Cloud infrastructure. Firebase enforces row-level security rules that ensure each user can only access their own data. Data is encrypted in transit (TLS) and at rest.

We implement industry-standard security measures including authentication gates, Firestore security rules, and API key protection. However, no system is 100% secure and we cannot guarantee absolute security.

The Service integrates with the following third-party providers:

• Google Firebase — Authentication, database, and hosting. Subject to Google's Privacy Policy.
• Anthropic (Claude AI) — AI mentor responses. Chat messages are processed by Anthropic's API. Subject to Anthropic's Usage Policy.
• MetaApi (agiliumtrade.ai) — MT4/MT5 broker connectivity. Your broker credentials and live account data pass through MetaApi to establish and operate the connection. Subject to MetaApi's Terms and Privacy Policy.
• PayFast — Payment processing for subscriptions (ZAR). Card details are handled entirely by PayFast. Subject to PayFast's Privacy Policy.
• Render — Hosts our backend server, which processes AI chat requests, broker requests, and payment notifications in transit.
• Twelve Data & Finnhub — Market prices, economic calendar, and market news data. Subject to their respective Terms.
• Forex Factory — Economic calendar event feed.
• TradingView — Interactive chart widgets embedded in the Watchlist screen.

We encourage you to review the privacy policies of these third-party providers.

Under the Protection of Personal Information Act (POPIA) and applicable data protection laws, you have the right to:

• Access the personal information we hold about you
• Request correction of inaccurate or outdated information
• Request deletion of your personal data ("right to be forgotten")
• Object to or restrict certain processing of your data
• Data portability — receive your data in a structured format
• Withdraw consent at any time (which may affect your ability to use the Service)

We retain your personal data for as long as your account is active or as needed to provide the Service. If you delete your account, we will delete your personal data within 30 days, except where retention is required by law.

Anonymised, aggregated data (with no personally identifying information) may be retained indefinitely for product improvement purposes.

The Service uses browser localStorage to store preferences (theme, sound settings) and cached app data (such as notification history and usage counters) locally on your device for performance and offline use. This locally stored copy is not transmitted to our servers, though the underlying account data it mirrors is stored in Firestore as described above. No third-party tracking cookies are used.

The Service is not directed to individuals under the age of 18. We do not knowingly collect personal information from minors. If we become aware that we have inadvertently collected such information, we will delete it promptly.

We may update this Privacy Policy from time to time. We will notify you of significant changes through the app or by email. Your continued use of the Service after such changes constitutes your acceptance of the updated policy.

Trading financial instruments including Forex, Indices, Stocks, Commodities, and Cryptocurrencies involves substantial risk of loss and is not suitable for all investors. The high degree of leverage available in financial markets can work against you as well as for you.

You can lose more than your initial investment. Past performance of any trading system, methodology, or individual trader is not indicative of future results.

The AI Mentor Chat feature generates responses using artificial intelligence. These responses are based on general trading education principles and your personal trading data. They are not personalised investment advice from a licensed financial advisor.

Do not make financial decisions based solely on AI-generated responses. Always conduct your own analysis and consider consulting a qualified financial advisor before making trading decisions.

Market data, economic calendar events, and news provided within the Service are sourced from third-party providers and are believed to be reliable but are not guaranteed to be accurate, complete, or timely. We accept no responsibility for errors or omissions in market data.

Magoro Smart Systems, TradeIQ Mentor, and its affiliates, directors, employees, and agents accept no liability for any trading losses, financial losses, or damages of any kind arising from your use of the Service or any content within it.

By using this Service, you acknowledge that you are solely responsible for your trading decisions and their outcomes.
