By accessing or using TradeIQ Mentor ("the Service", "the App"), operated by Magoro Smart Systems ("we", "us", "our") / MAGORO SMART SYSTEMS (Pty) Ltd, you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you must not access or use the Service.

TradeIQ Mentor is an AI-powered trading discipline and journaling application. The Service provides tools including but not limited to: market briefings, trade journaling, discipline scoring, AI-assisted mentoring, economic calendar data, and session notifications. Free tier logs trades manually or imports MT5 history file — no live connection, so no positions strip or Risk Shield, but full journaling and discipline scoring still work. Pro adds a live connection, the full AI mentor, and Risk Shield suggestions you approve. Elite adds full automation — Risk Shield executes on its own — plus unlimited accounts. Pro is capped at 3 accounts, Elite is unlimited.

The Service is intended to support trader education and discipline. It is not a licensed financial advisory service, investment advisor, broker-dealer, or trading signal provider. TradeIQ Mentor is an educational and discipline tool. It does not provide trading signals, execute trades on your behalf, or offer financial, investment, or personalised trading advice. AI-generated content may be incomplete or incorrect and should not be relied upon as the sole basis for financial decisions.

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are of legal age in your jurisdiction to enter into a binding agreement. The Service is not available to users in jurisdictions where such services are restricted or prohibited. You must be legally able to enter into a binding agreement in your jurisdiction.

To access certain features, you must register for an account using a valid email address or Google account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account. We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or pose a security risk. You are responsible for the accuracy of the information you provide, safeguarding your login credentials, and all activity under your account.

TradeIQ Mentor offers free and paid subscription tiers. Paid subscriptions are billed monthly in South African Rand (ZAR) on a recurring basis unless cancelled. Prices are displayed at the time of purchase and may change with 30 days' notice. The current public pricing as displayed on the landing page is: Free — R0 per month; Pro — R299 per month; Elite — R449 per month; and a Founding Member Pro rate of R149 per month for the first 50 qualifying members, subject to availability and the offer at checkout. The Founding Member rate is a limited offer enforced by the payment system itself, not marketing copy. Spots remaining are shown live in Settings → Plan inside the app.

Paid plans are recurring monthly subscriptions in South African Rand (ZAR), unless cancelled. The price, billing frequency, and any applicable offer displayed at checkout should be reviewed before authorising a transaction. Do not rely on the price in this document if the checkout page displays a different price; the checkout disclosure should be corrected before the transaction is accepted. All payments are processed securely through PayFast, a South African payment gateway. We do not store your payment card details — card information is handled entirely by PayFast. Payment authorisation permits the recurring charges disclosed at checkout until the subscription is cancelled or ends. Refunds are provided at our discretion for billing errors or service failures. Cancellation takes effect at the end of the current billing period; no further charges are made after cancellation.

You may cancel a paid subscription through the account settings panel (Settings → Plan) if the self-service option is available. Cancellation takes effect at the end of the current paid billing period, and no further recurring charges are made after cancellation. Retain any cancellation confirmation. If self-service is unavailable or does not function, contact support@tradeiqmentor.com. Cancellation stops future renewals; it does not automatically reverse a payment already collected for the current period. This does not limit any refund or cancellation rights that apply under mandatory law. Full details are in the Cancellation Policy.

Refund requests are reviewed under the Refund Policy. If a successful payment does not activate the purchased plan, report it promptly to support@tradeiqmentor.com, including the PayFast transaction reference, the account email, and proof of payment. We will verify the transaction and either correct the subscription entitlement or arrange an appropriate refund if the paid service cannot be supplied. Nothing in these terms excludes or limits consumer rights that cannot lawfully be excluded, including any rights under South African consumer protection or electronic communications laws. Refund decisions comply with mandatory consumer law. There is no blanket 30-day forfeiture window for failed upgrades.

You agree not to use the Service to: (a) violate any applicable law or regulation; (b) transmit harmful, offensive, or fraudulent content; (c) attempt to reverse-engineer, decompile, or extract the source code; (d) use automated means to access the Service without our express permission; (e) impersonate another person or entity; (f) interfere with the operation of the Service. You must not use the Service unlawfully, attempt unauthorised access, interfere with its operation, impersonate others, transmit malicious content, or reverse engineer the Service except as permitted by law. We may restrict or suspend access where reasonably necessary to protect users, the Service, or ensure legal compliance.

All content, features, functionality, design, code, and branding of the Service — including but not limited to the TradeIQ Mentor name, logo, Solfeggio sound engine, AI mentor system, and discipline scoring methodology — are owned exclusively by Magoro Smart Systems and are protected by copyright, trademark, and intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for personal, non-commercial purposes. Nothing in these terms transfers any intellectual property rights to you.

The AI Mentor Chat feature uses Claude AI (Anthropic) to generate responses. AI-generated content is provided for educational and informational purposes only. We do not guarantee the accuracy, completeness, or suitability of AI-generated responses for any specific trading situation. You acknowledge that AI responses are not personalised financial advice and should not be relied upon as the sole basis for any trading decision.

If you connect a MetaTrader 4 or MetaTrader 5 broker account, you authorise the Service to read your account data (balance, equity, open positions, trade history) and — where you have enabled Risk Shield / AutoShield features — to modify stop-loss levels on your open positions strictly according to the rules you configure. The Service never opens or closes positions on its own initiative and never places new trades.

Automated actions are performed on a best-effort basis. Execution is not guaranteed: connectivity interruptions, broker-side rejections (for example, a stop level too close to the market price), platform maintenance, or market conditions can prevent or delay a modification. Positions without a stop loss are not managed by automated features, and the Service will tell you so. You remain solely responsible for monitoring and managing your own positions at all times.

Broker connectivity is provided via MetaApi (agiliumtrade.ai). Your broker credentials are transmitted to MetaApi to provision the connection and are subject to MetaApi's terms and privacy policy. You may disconnect an account at any time from Settings. TradeIQ Mentor supports MT4 and MT5 only. No separate MetaApi dashboard or extra signup needed — TradeIQ handles provisioning behind the scenes.

Trading foreign exchange, CFDs, and other financial instruments involves substantial risk and may not be suitable for all individuals. Leverage can increase losses, and you may lose more than your initial investment depending on the instrument and account terms. Past performance does not guarantee future results. You are solely responsible for your trading decisions and should seek independent professional advice where appropriate.

The Service may rely on third-party providers for hosting, AI processing, broker connectivity, payments, market data, economic calendar feeds, and chart widgets. Third-party services may be unavailable or may change. Market data is not guaranteed to be accurate, complete, or timely. We will take reasonable steps to operate the Service but do not guarantee uninterrupted or error-free availability.

To the maximum extent permitted by applicable law, Magoro Smart Systems shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, trading losses, loss of data, or loss of goodwill — arising from your use of or inability to use the Service. Our total liability to you for any claims arising from these terms or your use of the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim. Nothing in these terms excludes liability where doing so would be unlawful.

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we determine violates these terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately.

Personal information is handled as described in the Privacy Policy. We may update the Service or these terms from time to time. Material changes will be communicated through the Service or by email when practicable.

These terms are governed by the laws of the Republic of South Africa. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of South Africa, subject to mandatory consumer protections and any mandatory rules in the user's jurisdiction.

Account data: Name, email address, profile photo (via Google Sign-In or direct registration), authentication and account identifiers, and information submitted to your profile.

Trading data: Trade journal entries, performance statistics, discipline scores, risk settings, favourite trading pairs, trading profile, journal entries, performance data, chat messages sent to the AI mentor, app settings, and activity required for features.

Usage data: Screens visited, features used, session duration, notification interactions, app settings, and activity required for features.

Device data: Browser type, operating system, device type, IP address, and technical data processed to secure, operate, and troubleshoot the Service.

Chat data: Messages sent to the AI Mentor, including any chart images uploaded.

Broker connection data: If you connect a broker account — your MT4/MT5 account login, broker server name, and account password (transmitted to MetaApi to establish the connection), plus live account data read from the connection: balance, equity, open positions, and trade history. Review MetaApi's terms and privacy policy before connecting.

Legal consent data: Timestamp and version of your acceptance of these terms, and timestamp and version of legal consent.

Payment information: Subscription and payment status, transaction-related information for managing subscriptions. Card details are managed by PayFast and not stored by TradeIQ Mentor.

Information is used to provide and operate the Service, manage accounts and subscriptions, personalize AI mentor responses using trading profile and performance data, deliver in-app notifications, investigate support requests, ensure security, comply with legal requirements, and analyze aggregate usage patterns for service improvement. Personal data is not sold, and trading data is not used for advertising purposes.

The Service uses the following providers: Google Firebase (authentication, database, hosting), Anthropic (Claude AI) for AI mentor responses, MetaApi for MT4/MT5 connectivity, PayFast for payment processing, Render for backend hosting, Twelve Data and Finnhub for market prices, economic calendar and news data, Forex Factory for economic calendar feeds, and TradingView for embedded chart widgets. These providers operate under their own terms and privacy policies, and some may process information outside South Africa. Users should consult each provider's documentation for details on data processing and international transfers.

The Service uses Firebase/Firestore, authentication controls, database security rules, API-key protection, and encryption in transit and at rest. While no internet service can guarantee absolute security, access to data is restricted to what is necessary to operate, secure, and support the Service. Personal information is retained as long as necessary for the described purposes, including providing the Service, maintaining records, resolving disputes, meeting legal obligations, and enforcing agreements. Retention periods vary by data category and legal requirements. Your data is stored securely using Google Firebase (Firestore), hosted on Google Cloud infrastructure. Firebase enforces row-level security rules that ensure each user can only access their own data. Data is encrypted in transit (TLS) and at rest.

You may update account information through available controls and request access to, correction of, or deletion of personal information by contacting support@tradeiqmentor.com. Identity verification may be required, and information may be retained where permitted or required by law. Where applicable, you have rights under South Africa's Protection of Personal Information Act (POPIA) and other privacy laws: Access the personal information we hold about you; Request correction of inaccurate or outdated information; Request deletion of your personal data ("right to be forgotten"); Object to or restrict certain processing of your data; Data portability — receive your data in a structured format; Withdraw consent at any time (which may affect your ability to use the Service). We will respond within 30 days. You may disable features that require optional information, such as broker connections, by disconnecting or discontinuing use. Deleting an account does not automatically delete records retained for legal or compliance purposes.

We retain your personal data for as long as your account is active or as needed to provide the Service. If you delete your account, we will delete your personal data within 30 days, except where retention is required by law. Anonymised, aggregated data (with no personally identifying information) may be retained indefinitely for product improvement purposes.

The Service uses browser localStorage to store preferences (theme, sound settings) and cached app data (such as notification history and usage counters) locally on your device for performance and offline use. This locally stored copy is not transmitted to our servers, though the underlying account data it mirrors is stored in Firestore as described above. No third-party tracking cookies are used.

The Service is intended for adults aged 18 or older and is not directed at children. The Service is not directed to individuals under the age of 18. We do not knowingly collect personal information from minors. If we become aware that we have inadvertently collected such information, we will delete it promptly.

We may update this Privacy Policy from time to time. We will notify you of significant changes through the app or by email. Cancellations become effective at the end of the current paid billing period and prevent further recurring charges. To cancel, sign in and use the subscription or cancellation control in your account settings panel (Settings → Plan), if available, as described on the landing page. If you cannot locate the cancellation control or encounter issues, email support@tradeiqmentor.com with your account email and subscription or transaction reference. Paid subscriptions are billed monthly in South African Rand (ZAR) on a recurring basis unless cancelled.

Unless otherwise stated at checkout or in your account, cancellation prevents the next renewal. Paid access continues through the end of the current billing period. Canceling does not reverse completed payments or automatically refund unused time. As stated on the landing page: 'Cancellation takes effect at the end of the current billing period; no further charges are made after cancellation.'

Submit your cancellation request well before your next renewal date. Payment processing times and time zones may affect when charges are applied, so early action is recommended. Keep your cancellation confirmation and contact support if a renewal occurs after confirmed cancellation.

Refunds are governed by the Refund Policy. If you believe you were charged after a valid cancellation, email support@tradeiqmentor.com with your payment details for review. This policy does not limit any non-excludable legal rights. Refunds are provided at our discretion for billing errors or service failures, subject to mandatory consumer law.

Subscription cancellation and account deletion are separate actions. To close your account or request deletion of personal data, contact support@tradeiqmentor.com. Records may be retained where required by law. If you delete your account, personal data will be deleted within 30 days, except where retention is required by law, as per the Privacy Policy.

This policy covers refund requests for TradeIQ Mentor subscriptions paid through PayFast in South African Rand (ZAR). Cancellation of a subscription stops future renewals according to the subscription terms; it does not automatically trigger a refund for the unused portion of the current billing period. Subscription fees are generally not refundable if a user changes their mind, does not use the Service, or cancels after a renewal. This general rule is subject to applicable law and the exceptions below. Paid subscriptions are billed monthly in South African Rand (ZAR) on a recurring basis unless cancelled.

Contact support if you believe you were charged twice, the amount charged differs from what was authorized at checkout, a payment was collected after an effective cancellation, or a successful payment did not activate the purchased plan. For a failed upgrade, provide the account email, PayFast transaction reference, transaction date, and proof of payment. A pending authorization or incomplete payment may not represent a settled transaction; status will be verified before determining next steps.

If PayFast confirms that payment succeeded but the paid subscription did not activate, we will investigate and seek to restore the paid entitlement promptly. If the entitlement cannot be supplied, a refund to the original payment method will be considered. We aim to acknowledge and investigate a complete report within five business days; this is a service target, not a waiver of any legal deadline or consumer right. Where a refund is approved and initiated through PayFast, the time for funds to appear depends on PayFast, the payment method, and the relevant bank or card provider. Specific bank-processing times cannot be guaranteed.

If our records confirm a duplicate subscription charge or an accidental overpayment resulting in a genuine cash credit, we will review the transaction and, where appropriate, refund the verified amount to the original payment method. Promotional discounts, vouchers, or courtesy benefits have no cash value and are not refundable unless required by law.

This policy does not exclude or limit any refund, withdrawal, cancellation, or other right that cannot lawfully be excluded or limited. If mandatory consumer law provides a remedy in your circumstances, that law takes precedence over any inconsistent wording in this policy. Nothing in these terms excludes or limits consumer rights that cannot lawfully be excluded, including any rights under South African consumer protection or electronic communications laws.

Email support@tradeiqmentor.com with the subject line "TradeIQ Mentor refund request." Include your account email, transaction reference, date, amount, reason for the request, and any relevant supporting evidence. Do not email full card numbers, passwords, or other sensitive authentication credentials. We will review your request, may ask reasonable follow-up questions, and communicate the outcome. Approved refunds will normally be processed through the original payment channel where possible.

Trading financial instruments including Forex, Indices, Stocks, Commodities, and Cryptocurrencies involves substantial risk of loss and is not suitable for all investors. The high degree of leverage available in financial markets can work against you as well as for you.

The AI Mentor Chat feature generates responses using artificial intelligence. These responses are based on general trading education principles and your personal trading data. They are not personalised investment advice from a licensed financial advisor.

Market data, economic calendar events, and news provided within the Service are sourced from third-party providers and are believed to be reliable but are not guaranteed to be accurate, complete, or timely. We accept no responsibility for errors or omissions in market data.

Magoro Smart Systems, TradeIQ Mentor, and its affiliates, directors, employees, and agents accept no liability for any trading losses, financial losses, or damages of any kind arising from your use of the Service or any content within it.

By using this Service, you acknowledge that you are solely responsible for your trading decisions and their outcomes.
